Terms of Service Agreement
DISCLAIMER: Please take the time to read through the terms to avoid any misunderstandings. The more we are "on the same page" the better!This agreement is between I, the Artists and you, the Client, for work services performed on a project known as the Work/Commission.The agreement refers to the discussion we, the Artist and Client, have about the Work in further detail.The Start of the Work refers to the exact day I begin sketching or gathering additional images to help out with the Work.
Content
I have the right to refuse any projects or requests that I don't feel capable or comfortable doing. These include
- Mecha / robotic
- Heavy armor
- Furry
- Gore
- NSFWI warrant that the Work will be my original work performed to the best of my ability. Artistic style is subject to minor change as I improve and develop as an artist.
Timeline and Process
It takes me a minimum of 2 weeks to complete the Work, but can average up to 4 weeks depending on complexity and workload of additional commissions. I will do my best to meet the deadlines, but know that it may not always be possible due to unexpected life circumstances.There is 1 major revision allowed at the sketching phase. After the sketching phase, only 2 minor revisions are allowed in the following stages. Minor revisions can only be made on small areas or accessories. I will actively reach out for feedback.Additional charges will be made for further revisions that can impact the progress and timeline of the project.Delivery of final work will be through Google Drive. Please make sure to save extra copies as I clean out my files frequently!
Communication
Communication will be through private messages on Instagram or Twitter. It will take place throughout the project for updates, ideas, or feedback. I typically respond quickly, but may take an additional 2 days to provide a better, more concrete update.You agree to provide ALL required art, visual images, information, and related material before Work starts and during the process. If you don't, it will affect the timeline, so please fill out the form completely to avoid any misunderstandings. The clearer information, the better!
Rights, Usage, and Credits
I, The Artist
- keep all the copyright and ownership of the work. I can use and post it wherever I see best fit. If it's confidential then I'll either delay posting it or not post it at all at the Client's request.
- have the right to place their signature within the Work. I'll make sure it doesn't impact the Work where it becomes distracting. You can get a non-signed version if an agreement is reached, but you aren't allowed to erase it under any circumstance.
- will most likely post this on their social media unless requested not to.
- can cancel and refund the order at any time for any reason and keep the rights of the Work, except if it's IP (intellectual property).
- WILL NOT profit further from the Work, unless you, the Client, breaks any of the terms listed.You, The Client
- get exclusive rights for PERSONAL USE ONLY. Personal use includes: social media profile pictures, layouts, themes, wallpapers, and social media posts that ARE NOT FOR SALE or distribution to anyone else.
- MAY NOT, at any time, modify, edit, or change the Work without permission from the Artist. The Work will be digital unless discussed with the Artist.
- MAY NOT edit, trace, or steal the Work for any reason, whatsoever.
- MAY NOT claim Work as their own or anyone else's. You have to credit me, as the Artist, using my social media handle @taurusvibez.- I am not responsible for printing [creating a physical, hard copy of] the Work for you unless agreed upon. You can use the digital file to print, so long as it doesn't breach any other agreements made at the start and that I allow it to be printed.
- Commercial licenses and reselling rights ARE NOT included, unless discussed and agreed on.
- Commercial licenses require additional charges on a case-by-case basis or as listed in the Work information.
- Any Work done or made available CANNOT be used for NFT or any blockchain purposes.
Payments, Cancellations, and Refunds
A 50% upfront charge has to be paid before starting the project. The remaining 50% is due at the first complete, low resolution, watermarked preview before giving you the final Work.Invoices will be sent after the Work has been accepted and discussed further in detail on chosen communication platform. Please DO NOT send payment without my approval.When the invoice or payment link has been received, you agree to pay within 3 days unless circumstances change. Please update me , otherwise I will postpone or cancel the Work.If you request cancellation 24 hours before the work begins, you'll get a full refund. Once I've started, refunds are NONREFUNDABLE. An example of starting work would be a rough sketch or finished line art.If, for any unforeseen reason, I can't complete the Work or it's significantly delayed by a month past the deadline, I'll inform you and provide a 25% partial refund based on the stage it is in. You will be notified if the Work is delayed.Once I receive the payment and the final Work is sent to you, I am not responsible for saving the file and will delete it. Please, save copies of it!Prices are in US Dollar and paid through PayPal. You are responsible for providing the correct amount. Taxes are included in the final payment!By engaging on any Work, once the transaction has been made through PayPal, you acknowledge that the product and anything else are DIGITAL. There will be no physical goods to receive.Chargebacks ARE NOT permitted and the refund policy, as mentioned before, will be followed.

Agreement
It is your responsibility to save all the Work as I, the Artist, clear out my files frequently.I have the right to cancel or refuse a Work if I find myself in a situation in skill, time, communication, or any other means that would leave me unable to do or complete the Work.By commissioning me, you confirm you are at least 18 and above or have a legal parent/guardian to agree to ALL of the terms of service as listed above.This is an agreement on both parties, I, the Artist, and you, the Client. It can only be modified if we both agree on it.The date of this agreement is on the exact day you request for a Work and again on the exact day the first transaction is made.By agreeing to this, you automatically accept my Terms of Service.
